James Merett Ware (born December 26, 1838 in Elyton; died October 17, 1888) was a nephew of James Mudd and a pioneer property owner in what became Birmingham.
Ware sold his estate in Fountain Heights to the City of Birmingham in 1873 for development of Oak Hill Cemetery.
Ware served as a Circuit Court Clerk and Register in Chancery for several years. He lost most of his wealth in his later years, and was said to have been "an habitual drunkard".
Ware was pushed down the stairway of a boarding house in Birmingham by its proprietor, Lon Pease. He died from his injuries and Pease was arrested. Ware was buried at Oak Hill.
