The 2009 Birmingham City Council election will be held on either August 25 or October 13, 2009.
The council voted on May 7 to change the election date to August on the advice from city attorney Lawrence Cooper that more than the usual three weeks would be needed between the election and any runoffs in order to meet the requirements of the federal "Help America to Vote" act. Cooper's office waited two months before applying to the U. S. Department of Justice for approval of the new schedule. If no decision is returned before June 26, then the October date will have to be kept.
